TERMS & CONDITIONS OF SALE
## 1. Purpose
These Terms and Conditions of Sale (the "Terms") govern the sale of modern art paintings through the website www.valerypaulguichon.com, operated by Valery-Paul Guichon, located at Las Vegas, NV 89130 USA.
Any order placed on the Website constitutes the buyer's full and unconditional acceptance of these Terms.
## 2. Products
The products offered for sale are original works of art and, where applicable, limited edition reproductions.
Each artwork is described as accurately as possible and includes, when relevant:
* Title of the artwork,
* Artistic technique,
* Dimensions,
* Year of creation,
* Unique or numbered edition status.
Photographs of the artworks are provided for illustrative purposes only. Color variations may occur depending on screen settings.
## 3. Prices
Prices are displayed in USD / EUR and are inclusive of applicable taxes, depending on the Seller’s tax status.
Shipping costs are not included in the listed price and are specified before final order confirmation.
The Seller reserves the right to modify prices at any time. Prices applicable are those in effect at the time the order is placed.
## 4. Orders
An order is considered final once the buyer
* Selects the artwork,
* Provides accurate personal and delivery information,
* Accepts these Terms,
* Completes payment.
An order confirmation email will be sent to the buyer.
The Seller reserves the right to refuse or cancel any order in the event of an existing dispute with the buyer.
## 5. Payment
Payment is due in full at the time of ordering.
Accepted payment methods include:
* PayPal
All transactions are secured using industry-standard payment systems.
## 6. Shipping and Delivery
Artworks are shipped to the address provided by the buyer at the time of order.
International sales are accepted. For international shipments, delivery times may vary depending on destination, customs clearance, and local carriers.
Any customs duties, import taxes, VAT, or additional fees imposed by the destination country are the sole responsibility of the buyer. The Seller has no control over these charges and cannot predict their amount.
All artworks are carefully packaged using professional, art-appropriate materials. The Seller cannot be held responsible for delays, losses, or damages caused by shipping carriers or customs authorities.
The buyer must inspect the package upon receipt and report any damage or anomaly within 48 hours, providing photographic evidence.
## 7. Returns Policy
All artworks are sold as final sale. Returns, exchanges, or refunds are not accepted under any circumstances.
## 8. Damaged or Non-Conforming Artworks
If an artwork arrives damaged or does not conform to the order, the buyer must contact the Seller at valerypaulguichon@gmail.com and provide photographic evidence.
After review, the Seller will offer a replacement (if available) or a refund.
## 9. Intellectual Property
All artworks remain protected by copyright and intellectual property laws.
The purchase of an artwork does not grant the buyer any reproduction, distribution, resale, or commercial exploitation rights unless expressly agreed to in writing.
## 9A. Certificate of Authenticity
Each original artwork sold by the Seller is accompanied by a Certificate of Authenticity.
The Certificate of Authenticity certifies that the artwork is an original creation of the artist and includes, where applicable:
* The title of the artwork,
* The artist’s name,
* The year of creation,
* The technique and medium,
* The dimensions
* A unique identification number or signature.
The Certificate of Authenticity is provided for informational and provenance purposes only and does not constitute a financial valuation or guarantee of future market value.
## 10. Liability
The Seller shall not be held liable for indirect or consequential damages arising from the purchase of an artwork.
In all cases, the Seller’s liability is limited to the total amount of the order.
## 11. Personal Data
Personal data collected is used solely for order processing and customer relationship management.
In accordance with applicable data protection laws, the buyer has the right to access, rectify, or delete their personal data.
## 12. Governing Law and Disputes
These Terms are governed by and construed in accordance with the laws of the United States and the laws of the State of Nevada, without regard to the conflict of law principal
